Notary must be an expert able to find the best solution for the parties not only from a legal but also from a fiscal point of view. The goal is always to provide the best service according to the specific case, ensuring the protection of rights and the best tax treatment. As we rely on a doctor for our health, according to a mix of evaluations, such as the relationship of trust that can be established, the reliability, the competence and the availability, the same applies to a notary for the purchase of our house. Our goal consist in creating a relationship of trust, in order to be the point of reference in the whole vast field of notarial expertises. Notary duties are often long and complex in the preparation of the deed and its correct execution represents a real safeguard for all parties. We have always been committed to having a fast exchange of information with the customer in order to proceed with the utmost speed, having always in our mind the protection of the customer.

IT notarial act

It is a common idea to associate the figure of the notary with infinite packets of paper. However, the role of the notary and his work has changed completely over the last years: the digital revolution has also arrived in this profession and new technologies acquired an essential role for assisting the client in today’s needs. This studio aims to be the main point of reference in this regard, having the latest IT-technologies in the notarial field, having adopted the digital form for all the acts.

_﹀ What is an IT notarial act?
It is the result of an apparently simple but also sophisticated procedure. An IT Notarial Act isn’t just a digitally-signed document by the parties and notary; it is also a document whose creation and subsequent conservation is guaranteed for an unlimited time with secure technologies that also ensure its accessibility. In this way, the notary guarantees its legal security also as an electronic document. Since 2013 it is possible for notaries to draft public deeds with IT technologies. It is therefore possible to use this technology to draft deeds and sign them with a digital signature, always in the presence of the notary and with all the prior checks used for the paper deeds.

_﹀ How does it work?
The parties, instead of signing a paper document, will sign with their own digital or graphometric signature the electronic document containing the deed itself and its attachments, followed by the digital signature of the notary (which contains signature and notarial seal). The IT notarial act will be stored electronically through a specific Conservation System, in accordance with the law, held by the National Council of Notaries on structures owned by CNN itself and administered by its own company, Notartel S.p.A..

_﹀ Why should I choose the IT public deed?
Ease of uploading and exchanging documents from other notaries or documents from the parties that would have otherwise to be sent physically, considerably shortening the time for preparing any deed. IT storage with the most advanced disaster recovery systems, ensures protection from any risk of damage to the original stored in an analog way. Absolute temporal certainty of the signing of the deed and absolute immutability the same as it is impossible to manipulate the electronic document once sent for IT storage. It responds to the specific needs of subjects who interact via speech synthesizers, both to provide and to acquire information. Eliminate paper in the drafting phase and, in particular, in the “storage” of documents, with low environmental impact, relating to document management, which will undoubtedly become simpler and more efficient thanks to the digital format.

_﹀ Why should I choose the IT public deed?

_﹀ The notarial graphometric signature
Specific software programs (Istrumentum, PNI) have been developed by Notartel, in collaboration with Aruba and owned by the National Council of Notaries, which allow people since January 2016 to sign their digital document with the notary, in absolute safety and simplicity. The new software programs don’t just take the signature image into the document, “taking a picture” of the graphic sign inserted on the tablet. Notartel has developed an advanced graphometric notarial signature (compared to the normal one already widespread on tablets) which allows, thanks to specific skills, to acquire a series of biometric data specific to each subscription, with peculiar characteristics of absolute security. The signature of each subscriber of a deed will therefore be associated with the writing time, the pressure exerted on the tablet, the position of the hand, the speed, acceleration and rhythm during the signing, even the inclination of the pen: these features can guarantee maximum security, creating an indissoluble link between the biometric traits of the signatory and the signed document and making it impossible, for example, to reuse the same signature for different acts. From an external and process point of view, therefore, the signature takes place in the exactly same way as it already happens for the traditional stipulation on paper. The client, the reading of the deed by the Notary and all the necessary explanations and clarifications, will be able to sign on the dedicated device (tablet) by seeing exactly the content of the document he is signing and its attachments. From a legal point of view, although the presence of the notary as a Public Official is sufficient to ensure the authenticity of the document up to a complaint of forgery, with the notarial graphometric signature it ensures that even if a protest of securities forgery is put in place, the presence of the biometric data and the accuracy with which it is acquired and sampled make the notarial deed also in the digital environment the safest possible document for our legal system.
